Waste valve state position?

Boat is still new to me and learning her.as I go.

This is the position of the waste valve and how it was set when I recently bought the boat. Is this in open or closed state? Beneteau 35.1

If the boat was on land for winter it may have been kept that way from the winterization and storage process.

If you're referring to the tank discharge thru-hull, it should always be kept CLOSED except when in use or the boat is out of the water. Water can be forced up the discharge line by the motion of the boat through the water and fill up the tank with sea water. The macerator pump can't block it, only slow it down. If you're away from the boat with it open, the water (and whatever else is the tank) will back up into the toilet, which will overflow and can sink the boat. Open below-waterline thru-hulls are one of the leading causes of boats sinking in their slips.

Finally got down to the boat this week - amazing how life gets in the way.

But... this is the gotcha. That waste valve picture -- is in closed position. As soon as I started to turn it I heard water start to flow and immediately closed again. Confirmed by flushing many times until black water tank level indicator started to show it filling up.

Well, "that's just against the laws of nature".
Perhaps you could see if there is a screw under that blue button on the handle by which you can remove the handle and rotate it a quarter turn to make it "right".

Any below-waterline thru-hull should always be kept CLOSED except when in use. This especially applies to the tank overboard discharge line. A macerator or other overboard discharge pump can only slow down water outside the boat attempting to seek its own level INSIDE the boat...there are none that can block it. Never leave the toilet intake thru-hull open when you leave the boat. The intake vented loop that you should install between the pump and the bowl as I described in another thread above will allow you to keep that thru-hull open while you're aboard.
