Waste valve state position?

Boat is still new to me and learning her.as I go.

This is the position of the waste valve and how it was set when I recently bought the boat. Is this in open or closed state? Beneteau 35.1

If the boat was on land for winter it may have been kept that way from the winterization and storage process.

If you're referring to the tank discharge thru-hull, it should always be kept CLOSED except when in use or the boat is out of the water. Water can be forced up the discharge line by the motion of the boat through the water and fill up the tank with sea water. The macerator pump can't block it, only slow it down. If you're away from the boat with it open, the water (and whatever else is the tank) will back up into the toilet, which will overflow and can sink the boat. Open below-waterline thru-hulls are one of the leading causes of boats sinking in their slips.
