The boat is documented.

You can't get to Seawanakah Corinthian Yacht Club from here, any here. Go to the club's web site and get the driving instructions and be prepared to get lost -- often.
Call me and I'll get you there with out getting lost.......easy

OK so here we are as of this moment. Having contacted Mitch Kramer I then contacted Boat US. After holding for this one then that one then transfered to another one and sent to voice mail the wait begins anew. In the interim the Yeraz II is owned by Mr. Peter J. Brennan and is the owner of record as of this date according to the documentation search at NOAA documented vessels site. The documentation will be a major hurdle to obtain title to this vessel and subsequent liens. So some serious untangling of ownership of this vessel has begun and any liens since filed against the vessel.

Oh yeah and another thing. In order to be reinsured the vessel must be surveyed and certified by the surveyor that it meets all current NMMA and ABCDEFGLMNOP requirements. In other words to the same standards as current production boats.

Boat US seems to move with remarkable stateliness. I sent them all the papers a few weeks ago, which included the executed Documentation Certificate, proof of loss, etc., etc. The local notary public has become a wealthy man. I have been assured that all is in order and that the check really, truly is in the mail. It did not arrive yet. I suspect it's one of those situations that we'll get around to it when we get around to it. I will continue to be the owner of record until Boat US returns the Documentation Certificate to the Coast Guard with new information on it. Meantime she is just sitting there in the rain and prey to any vandal or thief.

The documentation is not a major hurdle. There are no liens. Loan was paid off years ago. The change will be made in due course. There are fees involved for changing ownership. There are companies that specialize in changing documentation -- for a fee. As I mentioned, my Documentation Certificate dissolved in the water in the chart table. I got a new one -- fee $50 -- which is the one Boat US now has. We had a small glitch getting the new one as I put Yeraz 2 on the replacement application but the certificate says Yeraz II. Supervisor calling time.

I appreciate very much your looking into this. I did not realize it was going to be such a hassle, especially since the person I have been dealing with in the Claims Department has been helpful personified. In one case she sent us documents but it turned out the documents did not actually go into the mail for another week. And I think that's where all the paperwork is languishing. I am really surprised as they moved very fast initially.

What I think I know about CG Documented boats.

When we bought our Tartan 27 over 10 years ago the previous owner (PO) had the boat Documented and it had (still has) a CG plaque in the cabin with the Doc # on it (we were supposed to remove it but never did).
For whatever reason the PO decided to cancel his CG Documentation before the sale of the boat. I assume that he canceled the Documentation so it would be easier for us to transfer ownership through the normal DMV channels and not have to wait for the CG Documentation office to process forms as well as the fees required.

I'd also assume that Boat US might put in paperwork to cancel your Documentation as owner so it is easier for them to do what they choose with what is now their boat.

Those are a bunch of my assumptions.

Among the documents sent to Boat US -- all of them notarized -- was Proof of Loss, Limited Power of Attorney, Bill of Sale, US Documentation Certificate, Original 1994 Bill of Sale from previous owner to us,original paid-up First Preferred Ship Mortgage, New York State non-transferable Boat Registration card, Inventory of on-board systems and equipment. Take awhile to process all that I guess.

I think you are right Peter. No call as of yet. With the speed of geology Boat US charges forth.

Just received a couple of letters from Boat US that make things clearer. Don't hold your breath about getting access to what was our boat.

One letter contained the settlement check and states our policy is being canceled. We no longer own the boat.

The other letter is addressed to Seawanhaka Corinthian Yacht Club "To whom it may concern." It's a cover letter for a check amounting to $7,311.34 covering emergency services and a disposal fee of $3,800 to help the club dispose of the vessel. Jeez! That's more than twice our annual slip and storage fees. Basically, the Club has no incentive to be nice to anyone including picking up the phone. I quote: "Enclosed you will find the vessel's original USCG Certificate of Documentation and N.Y. Registration so that you may proceed with the disposal of the vessel." Both letters are dated August 24 but postmarked August 31.

End of story, I guess. You can bet somebody has a well-placed friend or relative out there. This is a Big Boy's game to which the rest of us are not invited.

Damn, damn, damn. That's a damn shame to bust up an otherwise great boat. You are dead on Peter. Somebody is looking to recover all or as much cash as they can off this one. Sorry I couldn't grab it. I would have loved to restore that one. If I ever win the lottery I swear I'm going to open an Oday reconditioning shop. Again sorry for your loss Peter.

I can only suggest that you try again to contact Robert Satori, the Club's yard manager. They are not out any money. Indeed, they have gouged the insurance company.

I want to keep track of the boat. Where is the documented web site where you can check the ownership of a vessel? Tried the Coast Guarde and was told there is a fee for that information.

Thanks for the URL. And I agree about their attitude. They are no better in person, a really snotty crowd.

Some people with connections to Seawanhaka are going to do some digging for me. Stay tuned. Meanwhile, documentation has not been revised.

Thanks Peter. Even if someone grabs her I would still like to be the one to bring her back. Keep me posted.

So I met a fellow sailor who keeps his boat at Seawanhaka Corinthian Yacht Club and he tells me that one of the fellows over there repairs and sells boats like Yeraz so that explains why the snotty bunch is button lipped

The best way to make these type of deals work is to have the owner to buy back from the insurance company. They give you the boat at salvage price and a check for the balance of value. Once in the insurance company system it will often go to a salvage company by contract. No chance for private purchase from insurance company. I have bought back cars and motorcycles this way from owners. They retained possession of the vehicles then sold to me. Once in the salvage company system their profits on the sale make it harder to fix for a reasonable price.
