Seems that the issue should be the responsibility of the broker, not only finding a captain but also paying the fee & being present for the survey. Interesting thought, but I question if the broker conducts a sea trial would that (under the law) require the broker to be a licensed captain? I suspect it would, because (s)he is being compensated.
