Pay the money!

After 832 views by dedicated sailors (like, who else reads this site?) the damage done to reputation is so much more than the amount in question, regardless of the merit of the claim. Pay up and Tim will shut up, and in a few weeks this post will be off the site, and maybe people, in time, will forget your name. As a small business owner, I would pay 10 times this amount to avoid this kind of bad p.r.

Sad story

I will be off to the US Sailboat Show in Annapolis next week, and I'm appreciating the alert regarding The Canvas Store. I'm actually representing more than myself in researching winter boat covers. What boggles my mind is the fact that a company like this will step on one customer for a few bucks and not consider how many sales it will lose as a result of that customer telling a bunch of other folks who may be in the market for the product that company sells. They may squeeze $1,400 bucks out of you, but perhaps lose tens of thousands from the loss of business. This is evidenced by some on this thread already mentioning they will not buy from this company, let alone those who will not buy from them but just are not mentioning this fact. The Canvas Store could have just settled with you and avoided a big mess. By the way, this issue has spread to other forums now, so there’s no telling how much business this company will lose, for the sake of $1,400 bucks. In my mind customers can take actions based on "principle," but businesses cannot. Look at Nordstrom’s. They will exchange a product that they don't even sell to satisfy a customer. Granted, that's not necessarily $1,400, but that’s the price level The Canvass Store finds itself. Sure, a couple folks on this thread have said nice things about this company. However, the thread is about the problem, unique or otherwise, you are having with this company. The point is you had a problem with the product and the company should have done right by you in the beginning. While some customers are very satisfied, how many out there were not willing to go the distance you have? Obviously, few have done this, if not none. It would be interesting to see what the Better Business Bureau has on them. I myself will be looking at other vendors for sailboat covers! Good luck

Interesting what David said

"and in a few weeks this post will be off the site" That is if there is no activity but if every couple days someone adds to it who knows how long it'l post. So it would be in the best interest of TCS to pony up the money and get this and all the bad PR behind.

Judgments are not self collecting and the Sheriff will not seize assets just because you request relief. It is not illegal to not pay judgments and it is a very rare situation where the judge will order the debor to pay. Email me through the owner directory and I will give you some guidance for getting paid. Scott Wilson "Celebration" H37 cutter

You can not renew a consumer affairs licence with an outstanding judgement against you or your corporation, Oh maybe they don't have a licence well thats another can of worms and I'm sure Tim has checked that out by now.

Scott in Seattle...

Scott, I tried searching the owner directory and you don't come up with name or boat name for some reason. You can email me through the directory (I just updated and checked it) or to the email I listed about 5 posts down. Thanks, Tim

it's all about follow up

anybody can make a mistake, espeically making custom making custom products like this. it's all about the follow up. what I've found at TCS is unanswered calls and broken promises. you have to be ready to support expensive products like these!

Any update, Tim?

Tim, Just wondering if the activity on this site had any impact. Curious that we've received no further input from their operations manager. Dave

No news

Dave, No news from TCS. I spoke with the Sheriff's office today about how the next steps work, and I plan to go ahead with them shortly. I'm still waiting for the paperwork to fill out and return to them. Thanks for bringing the topic back to the top of the Forum! I'm going to offer TCS one last chance to make this right, stay tuned. Tim

Open letter to Steve McGovern

Mr. McGovern, Since I know you are aware of this thread, I will offer you one last chance to settle this matter in a reasonable fashion. The transcript of judgment I have from the court to file with the Sheriff's office shows you now owe me $1709.22 including all interest and fees to date. If I receive payment, in the form of a certified check or USPS money orders for a total of $1500 by 7:00 PM October 5th, 2006, I will consider the matter settled and will notify the court and county clerk as such. I will also post on this forum that you have settled the matter per my offer. Should you continue to ignore me, and the court, I promise to pursue this until I get the full amount owed to me, including any additional amounts for the collection process should I be entitled to them. Fact: You sold me a cover that did not fit my boat. Fact: You refused to deal with the issue for at least 15 months. Fact: You are in posession of the cover. Fact: The court has ruled against you. Fact: There is no Trial de Novo (appeal) pending. There is nothing left to debate. Please make this easy on both of us and accept my offer of settlement above. Regards, Tim Porter

If still no answer...

Contact the ISP and have them shut down their web site. That might get some additional attention. If you need hlep getting the website info (IP address, owner, ISP, ets) let me know.

McGovern is a piece of crap!

I hired Steve McGovern to build a Bimini for my B 370. I paid him $1,000.00 up front to start the job. He promised the job completed within 5 weeks. On the third week, the "bows" were installed. On the seventh week, I started calling and asked when the job will be completed. Knowing that he had me by the "short hairs", and knowing how finicky these guys are, I spoke to him very politely. He hung up the phone on me! I called him back and he hung up again. I eventually got the bimini, however; the "connecter" piece zippers weres sown upside down. You would have to be hanging from the mast to zip the thing together. I do not know of anyone who has had a GOOD experience with Canvas Store. Jack B370

I have not chimed in on this yet, but just can't believe what this company has put you through and I just want want Mr McGovern to know that there are THOUSANDS of folks like myself, that just because they are not posting, are reading this, and as of right now, would never do business with him!

Maybe a new heading need be entered

with the canvas store name and buyer beware in large letters next to it. Example; NY Canvas Store, BUYER BEWARE, With the story reprinted with a time line. That way all can see it easily and so can potential customers along with the staff and owners of the establishment. I'm just not sure on any repercussions this might involve. Ask the attorneys first. Good luck and Keep it up, Ctskip

Sounds like McGovern at the Canvas Store

is an INCREDIBLY STUPID business man *o How much negative publicity did you receive because you were greedy and didn't refund Tim the money for the Canvas? How much money do you spend in advertising a year? What ever it is, it will never replace the business lost due to this. McGovern , it sounds like you are a foolish, stuborn (greedy?) man and undoubtably your pocketbook will pay for it How much lost future revenue has occured due to screwing Tim and just not refunding the money to someone with a product that obviously doesn't fit? (Note: That was a incredibly lame response by Rebecca Windsor from the Canvas store. She even said QUOTE: " We told Mr. Porter we would refund his money if the cover did not fit." Well even the COURT documents said it was "non-conforming goods" So why don't you just PAY Tim the money !?!) Obviously this was not an isolated incidence so for here and ever more I will make sure I tell anyone, in person and on the internet, never to use "The Canvas Store" on Long Island NY and I will tell them why.
