Just heard the tail end of this on the radio while ago. A couple on a sailboat, enroute from Cozumel to Houston had some problem of some kind. Rescued by the CG. Apparently just happened. I was not paying much attention and just caught the tail end. Anyone have any more info.

If they left their EPIRS running finding the boat should not be difficult.
Good point Caguy! That is a two edge sword! You can find it easier but unfortunately it also attracts other people that you may not want to find your sailboat.

I am sorry for their loss and their troubles.
That being said, I understand a person hoping to find their boat again but wish the coast guard would shoot the boat to sink it instead of leaving it afloat and being a hazard to others. Yea i know it's a big sea out there but I couldn't imagine me leaving a boat adrift and then finding out someone else had a collision with it and they sunk or were harmed. There should be a rule, if the boat is not close enough to be towed to a shore then it should be scuttled .
I know this would be an emotional issue, it would be for me but I feel the safety of others should be considered.

I think a better answer is to hang a couple of sea anchors on it and auction off the location to salvagers. Everyone wins except the insurance company (in the long run the insurace companies never lose).

The Gulf of Mexico is strewn with unlit, abandoned oil wells and stand pipes. An abandoned boat is the least of your worries out there.

So what happens to that boat? Is it a finders keepers kind of thing? If someone finds it can they claim it as theirs at no cost?

DJW, I believe that if a salvager finds the boat abandon they can claim it.

They can "claim it" but that does not mean it is "theirs." The owner can say, "Hey that is mine. I never abandoned it, expecting to never come back. I left it un-manned but intended to reboard it ASAP."

If there is a competeing claim it would go to a judge and the rules of salvage will be implemented. The boat may be returned to the owner and his insurance may pay the salvor a hefty fee.

Robert, true, claiming and ownership are two different matters. However, as the saying goes "possession is 9/10's of the law" (or something like that). I guess the owners could say they never meant to abandon the boat long term and where "forced" to leave it by the CG. However, and anyone that knows better please correct me, the fact that it was abandoned and left adrift opens it up to salvagers who could claim it and possess it possibly to "sell" it back to the Insurance company.

Here is an interesting question... if you anchor your boat and walk away from it is it abandoned and open for salvagers? I would say not. The fact that they left it adrift might be the key factor here... Your thoughts?

Being adrift means it's definately "salvage", but not free for the taking. In court, where a lot of these things are settled, the salver is owed reasonable fees for recovery based on the risk and effort. They would not be given title unless the owner/insurance company was unwilling to pay out what the judge declared reasonable.

If you find a boat and tow it in and owner or insurance wont involve themselves. If said boat then sinks in channel or dock. Who then is the person responsibal for removel of boat and oil slick.

If they had deployed a sea anchor would it still be considered adrift. Things to think of if ever in that situation where you have to abandon ship.

Caguy, if I ever got to the point where I had to abandon ship I probably would be so frazzled that I would not even think about it. Additionally if I were in a serious medical situation and my wife had to hand it I am sure it would be the LAST thing on her mind! In that case you just have to do it and deal with the consequences later. I am sure that is what she was thinking about as well.
