I was recently offered part ownership in a badly neglected sailboat if I would agree to fix it up to sailable condition, maintain it and split the dock fees. Structurally, the boat is in good condition, water and termite damage inside, poor wiring and plumbing, don'a know anything about the mechanicals. I have not been able to determine the year or make of the boat. Amazing to me that in older boats, the manufacturers name was often barely displayed. the bot is CG certified, but for year and make is entered undetermined! The boat is 40' by 12.2', has a swing keel, and a (I think) 3 cyl Yanmar. I think it may be an old Irwin, but no reason to believe that. Will try to attach a picture for you boat buffs. Any help would be appreciated.

I would be very careful here. Lots of curve-balls and gray areas. An old boat needs lots of attention, time and money to make "sailable". And what is the definition of "sailable" here? Its one thing if you do all this work / invest $ and its 100% yours -- but to split 50-50 on something that is going to become very abstract is going to be tough.
There are lots of used boats out there that need TLC and if your handy you can pick one up for a bargain.

All I can see is an almost limitless number of ways to get screwed on this deal. All the good will in the world will somehow turn into the owner selling it and you getting bupkis for your time and financial input. I've seen it happen so many times, on things other than boats (like vintage cars, amoung other areas of interest), that I would run fast and far and never look back.
OR, buy it for what it's worth now, assuming you can gain full legal ownership, and invest time and money in order to resell it.
That's all assuming it's not a giant wreck that will vacuum you time and wallet and still not be worth anything. It also assumes the present owner will actually sell it for what it's actually worth on the open market, which is probably not much since the deal involves you putting it into salable condition in the first place, and you only gianing half the total receipts.
Maybe that leads back to running fast and far and never looking back.

There is hardly a more expensive thing than a free boat.
If there is no title, check to see if one is required. My 25 footer didn't require one here in Maine, but it's possible that larger ones may. MS, Tim, Gail, chime in on that if you're hanging around. Sailable might actually require sails. If this is the case, don't run, drive away fast. Rigging, similar but if it's decent repair, that might be OK. Has it been surveyed? That would tell quite a tail.

I'm agreeing with all of the above. I deal with sail boats everyday, and this one is almost a giveaway.

IF it's something you cannot refuse, money by you, and the other party/parties should be deposited into a trust, or account if you will, to collectively "restore" the boat. And then, a FIRM agreement, with a snake-handler,(lawyer), to oversee the dealings, before, during, and after.

please do not confuse ericson with irwin. ericsons sail much much better than do irwins. i know--btdt with both citation irwin and ericson 35, which i still own. this definitely an ericson 35 mII.
ericson is a bruce king design and is a very good boat. they clean up well and sail like heaven.
this boat is worth every penny you stick into her and will give you many years of good sailing. SHE WILL EVEN WIN RACES....

Jluke, I went through this about 10 years ago. Bought a 20' sailboat that did not have registration papers, as not long ago, a 20' sailboat didn't need to be registered in Louisiana. Turns out the rules had changed. My seller didn't have registration papers.
The Dept. of Widlife & Fisheries, which registers boats in Louisiana, told me if I didn't have reg papers, I could go to a Justice of the Peace Court and be declared the owner. Knowing the costs and hassles of that, I called the previous owners, some of whom had moved. Finally got the original seller/retailer, and he and the owners in the chain of title gave me affidavits. When I presented that to the DWF lady, she was amazed I had gone through all that, and went ahead and registered the boat to me.
And if it's CG (federal) registered rather than state, you should be able to get title info from them. I believe there's a company or agency that records federal maritime liens and mortgages, which may be of help if your boat was financed.

hhmmmm upon looking a ther more thoroughly, there is only 1 large port-- so could be an irwin--but she looks more ericsonish... ericsons have 2 window ports, not just one. dont have a citation here to compare it to, so ....did you look on transom for the hin?? should be on stbd quarter, transom.
