Washington Sellers Beware

So this is something that I just discovered. The State of Washington doesn't care about a vessel report of sale. So here is what is going on. Back in 2021 I bought a 1963 Ericsson 26 for $300. I only wanted this vessel for a quick flip and that's exactly what I did. I transferred the title into my name and paid the registration all legal like. I sold the boat a few weeks later for $600 (after some major clean up work) and the new owner was happy. But to me he seemed like the type that may not transfer the title so I made sure to get his information and I filed the seller's report online at the WADOL site. Fast forward a bit over a year later and I get a call for the WA DNR (Department of Natural Resources) saying that my boat has run aground. I don't currently own any boats, I am in the market for one though. I let them know that I sold the boat back in 2021, and I know that it had changed owners at least once since then, as I stayed in touch with the buyer for a short period of time and he told me he was selling it as well.

So they take my statement that I sold the boat and said they would investigate the ownership. Great. Well today I get a certified letter saying I needed to recover my boat, or call them. So I do and I talk to the same person that called me about the boat a few weeks ago. She said the state DOL will acknowledge I filled out the seller's report but they don't care as I was the last registered owner. The DNR people asked me if I still wanted the boat and I said not really, I didn't much want it in the first place, it's ugly and I just bought it as a quick flip. I actually never even moved her while I owned her.

So my problem is I have already deleted the buyer's information from my phone. I didn't make a bill of sale as in WA the title can be used as a bill of sale since it has an area to put the dollar amount and signatures. DNR has been pretty cool about it all and is working with me to either recover the boat or have it scrapped at no cost to me, which is good but I am now dealing with something I thought was long gone.

Moral of the story here, make sure to create a bill of sale, or better yet take the new owner to the DMV and have them transfer the title right at the time of sale to prevent this from happening to you. If you are in a state other than WA, you may be in better shape than us here in WA. The lady at the DNR couldn't believe how the state disregards the seller's report, yet we can be fined if we don't fill one out. If this had been Water Lilly or Luna (Especially Luna) I would have been all over being able to repossess my old boat, but not this one. Ericsson 26s are strong and well laid out, but boy are they ugly!

Just thought I would put this out there, even when you do everything right, you are still responsible for someone else's wrong.

A good lesson. Thanks for posting. Most of my boats were sold in NY. I always assumed the new owners wouldn't register the boat so I created a BOS for all of them. I also wanted to separate from the liability if the boat were involved in a loss. I still have them, some for more than 40 years ago.

It ain’t over til the paperwork‘s signed and the Governor’s happy.

Never had a problem with a boat. Always have been careful when selling a car. For exactly the same scenario. New guy gets a car and crashes 5 blocks away.

The days of handshake deals are long gone.

Hope you get a fair and correct resolution.

I had a similar experience with a marina contacting me for back rent on a boat I had sold five years earlier.

Our state takes the seller’s report seriously when it comes to motor vehicles, but not vessels. About the only thing they have lightened up on, and only since they started considering license plates property of the owner and not part of the vehicle, is allowing a vehicle to be driven home on the day of sale without plates. If you get pulled over just show the title signed and dated the same day and unless you really pissed off the officer you will be sent on your way.

You say you filled out the online sellers report with the buyers information. Then you say you lost the buyers information. Just ask the state to check with the buyer you listed online.
That is what the DNR did and the DOL refused to give the information “due to privacy concerns”. Which makes me wonder why would my information be so readily shared.

The buyer probably never registered the boat since he flipped it too. Now it's on the rocks and your buyer is nowhere to be found. Sounds like us taxpayers problem.

Something like that yea. It's not on the rocks any more, it actually didn't get hurt at all from being beached. It's sitting at the public dock at Swantown Marina, the 6hp Johnson engine that's onboard actually runs pretty good and over all she is not in bad condition. If anyone here wants her I will help you get her but I'm not interested in this boat at all.

Who knew? I got caught up in that last year. Had a small boat sitting on a trailer in my yard for several years. Registration on both had expired long ago. A man approached me about selling and after a few minutes of haggling, (actually I would have accepted any offer), I signed the title over and off he went. Still attached to the trailer was the long ago expired tag. Several months later I get a bill in the mail for $6.25 for a toll charge, along with the pic of the back of the trailer and boat with, you guessed it, the expired tag. After going back and forth with the company that collects the toll fees I get another bill for $8.75 for late payment. After much going back and forth again with this toll company, I get someone that informs me the tag is still my property and I need to go to the DMV and cancel the tag amd send the documentation to the toll co. I still had to pay the $8.75. :facepalm:

@Roland5048 you folk in FL have some interesting Toll Road rules.
I just got a letter about a class action law suit involving a rental car company and the tolls they billed on rental returns.
