I have repossessed a sailboat recently and am looking to sell it. However, the title to the boat is not in my possession as the borrower told me she never had it. How do you get information about whether the boat ever had a title? Secondly, when I get a title through whatever process I need to go through is it going to have a salvaged title on it even though the boat does not have damage to it. Any thoughts are much appreciated

This is what the lawyers are in business

for. If you have all of the paper for the mortgage the lawyers should be able to make short work of it.

Some State don't require titles

I have purchased 4 sailboats and the only thing I ever received was a Bill of Sale. Even when I registered the vessel in Tennessee I only had to show the bill of sale. That is all I had to send when I documented one of my boats. I am not sure about all this but it worked for me. Cars have titles in TN but not boats. So if you find someone to buy the boat the only thing that will be required from the old owner is their Bill of Sale. I am not sure for other states. I hope this helped.

I tend to agree with Rick. A bill of sale and pay the taxes in the area it's sold in, pay to "register" it with the state, and you should be fine. Only other issue would be if it is "Coast Guard" registered...1980, 22ft., I doubt it...

Just went through this....

Bought a boat that had been given to a not for profit agency. In California, I had to go through a long and painful lien process to finally obtain the title. After which, I had to pay back taxes to the local county prior to the state allowing me to register the boat. To determine the process, contact your local DMV and see what thier process is. It is a cheap first step and there may be an easier way to deal with this. Rick
