Marina theft

I keep a 23' at a Marina on Pleasure Island by Port Arthor Tx. and had an out board motor stolen, the lock cut off the cabin and from inside I had various hand tolls and a drill stolen. They left the GPS and VHF radio. I suspect kids.

Bryan, its a real shame that happened but I

think you may have misplaced your trust in the marina when their only responsibility was probably regarding the safe haulout and storing of the boat. Any special requests, favors or accomodations that were performed or left undone will likely not affect their contractual liability. And even if they had contracted to place the boat on the trailer and did'nt their liability would probably stops at the haulout fee. The ocurrence of the trailer being stolen cannot be directly tied to whether it was loaded or not. You can argue that an unloaded trailer is an easier target but you cannot definitely point to it as the reason for the theft. The security of the trailer was always your responsibility unless expresively accepted by them. Was there a charge for the storage of the trailer that may indicate some obligation on the marina's part? I hope the trailer was insured.

Insurance

Bryan, Sometimes trailer ia covered by Automotive insurance while moving. Personal water craft may be covered by house insurance if endorsed. Worth checking.

Public Access in NJ

The New Jersey DEP has just propsed new rules regarding public access to all waterways and if adopted, will require that marinas provide unlimited public access to all docks, slips, ramps, etc. 24/7. There has been a lot of outcry from the marina owners and some of the boating public voicing security, liability and safety concerns.

Outboard thefts...

anyone who has had an outboard stolen, report the theft to the manufacturer's cutomer service department. They then flag that serial number and any warranty repair request for it becomes a notification to law enforcement. Dealers about to work on a motor of "suspicious origin" can check this list and find this info out and do their own notification to law enforcement. One summer alone we caught three this way.

Update

Well..bought a new trailer. Insurance is still in the works, and probably will be for a long time, while the police report reads "We checked the marina yard, and the trailer is not there." So, while we wait for the insurance to pass down their almighty judgement, we're trying to negotiate the possibility of free dockage for next season (in the even there is no insurance reimbursement). Sound fair?

When you get your new trailer, lock a golf ball into the hitch ball receiver. That will give a would-be thief something to think about when he tries to drop the tongue onto a hitch in the middle of some dark night!

Good to finally have resolusion.

I love my boat too much to leave her for two months unchecked. Why didn't anyone followup contact with the marina about the transfer to the trailer. It seams to me that I would have called to find out how it fit the trailer after spending that much money for that item. We are the customers and pay the bills at these marinas. Demand answers! When we were cruising we were amazed by the number of boats that just set untended. These represent large investments for most people but are treated like broken down bicycles probably 25% of the owners. Again, I'm happy for your conclusion, now stay intouch with her. Ray
