If we are all familiar with, and aware of the zoom problem with chart plotters, one would have to assume a professional captain of a cruise ship with probably as many miles at sea as most of us combined, would most definitely have to know about that too.
Any captain that skirts land with closely examining the charts is guilty of negligence, even if they don't hit anything. It looks to me like they got lucky last August, he figured he would do it again, not realizing how close they came before or bothering to examine the point close enough to see the rocks, and his luck ran out, and cost people their lives.
I see nothing so far that suggests he should not be held liable.
