A condition of the contract with my book publisher--the material in it may not be published "in whole or in part" elsewhere. The Headmistress Library was the basis for several chapters, so it had to come down. My book should be out by early spring, btw. That doesn't mean I can't answer questions, though...what were you looking for?

Looking for

the current laws on MSD Type I discharge. The local Raritan dealer says he's taking them all out instead of installing new ones because "they're illegal inside the 3 mile limit." I know that's garbage, but I wanted to see the laws and it's hard to find on the EPA or USCG web sites.

And he's a Raritan dealer??? First thing tomorrow, call Raritan (800-352-5630)...tell 'em what he's saying and doing. I promise they won't put a contract out on him...but they will set him straight--and should. Not only because he's giving people bad information, but because he's costing himself sales and installation profits on Lectra/Sans...unless he has some kind of enviro-wacko agenda. But that only gives him the right to try to make a case against treatment, it doesn't give him the right to lie to people. I'll forward a link to this thread to Raritan too. You won't find the laws on the EPA or USCG site...the law you're looking for is in the Code of Federal Regulations...CFR 40 140. 1-3. (Link below). To summarize 'em in a nutshell: Type I and II MSDs are legal in ALL US waters except those that have been specifically designated a "no discharge zone." Galveston Bay has not been designated a "no discharge zone"...the Lectra/San is a CG Certified Type I MSD. Ergo, it's legal in Galveston Bay.

Contact your local Coast Guard office and ask for a copy of U. S. Coast Guard Consumer Fact Sheet #13 - then HAVE THEM READ IT, too! It pertains to marine sanitation, Types I, II, and II MSD's, etc., etc.

One more question about MSDs

Peggie, I'm gonna call Raritan as you suggested, but before I raise all sorts of hell, I wanted to clarify one thing first. I read the CFR 140.3, and section (d) seems to require that vessels built recently (1980 or later) need an MSD Type II to discharge legally (200 or less coliforms per 100 ml). Of course it's written in govenment gobbledegook! I must be missing some fine point if the LectraSan (Type I) is legal (which I'm sure it is). Please help my muddled head. Thanks. George

Type II is only required on boats 66'+ LOA

Vessels under 66' may use a Type I as defined in 140.3(a)(2): "In all other waters, Coast Guard-certified marine sanitation devices installed on all vessels shall be designed and operated to either retain, dispose of, or discharge sewage. If the device has a discharge, subject to paragraph (d) of this section, the effluent shall not have a fecal coliform bacterial count of greater than 1,000 per 100 milliliters nor visible floating solids." The CFR makes no mention of which device is legal on what size boats...Coast Guard regs do, though--the same Coast Guard Consumer Fact Sheet #13 Vic referred you to. As for "raising hell" with Raritan about your local dealer, Raritan doesn't have "factory authorized dealers'...any boat store or yard who wants to sell Raritan products can do so. It's up to the yards and retailers to know what is and legal in their own local waters. It's not Raritan's fault that he doesn't know any more than the average kid at West Marine or BOAT/US. If I were you, I'd get a copy of CG Fact Sheet #13 and mail it to that dealer with a note attached suggesting he read it before he drives away any MORE business...'cuz he's lost yours. I can't help wondering how many other kinds of products he's giving people bad advice about. There have to be at LEAST dozen yards in your who will happy to sell you a Lectra/San AND install it correctly--something I doubt this idiot knows enough about it to do either.

I found the law, but...

Apparantly vessels under 65 feet are allowed to install a Type I MSD under a waiver written in the federal register way back in 1978. But I can't find anything to determine whether that waiver is still in effect or cancelled. Do you know where to look for that info? I wonder if that's the reason for all the conflicting ideas. Thanks, Peggie.

But if the Lectra/San and other Type I MSDs weren't a legal device on boats under 66', why would the CG certify 'em as Type I MSDs? It doesn't stand to reason that the CG would certify a device that isn't legal.

It's a bit out of date...but better than nothing

I haven't revised it since 1997. The laws haven't changed, but a lot of other things have.
