For the final time, the boat (Rosewood) belongs to me free and clear and I do not want to put any one in jail that may be an innocent victim in this whole sham, which is what could happen... Even though I am advised different by legal and law enforcement, I will give it a bit more time before I lose my good nature...

There is a provision in the law that addresses stolen property. If the present possessor obtained it innocently but wrongly then he can cooperate with law enforcement to see the wrong doers brought to justice. Receiving stolen property knowingly is also a crime.

Is the perpetrator of the alleged fraud a friend or family member that you are trying to spare ugly consequences? Fraudulent papers come in many forms, was a notary involved? I think is time you hire a private investigator. He can check for you any registration at States level and find out if any insurance has been taken out against that hull #. Marinas in the US will likely require proof of insurance. I see the boat is still registerd in your name with the USCG so whoever purchased the boat seemingly did not perform due diligence in veryfying for liens and title. I could understand that for a $5,000 boat but not for a 54' boat. Something does not add up. The longer you delay taking action the lesser the chances of locating the boat. As opposed to law enforcement a private investigator will dedicate more time and effort to locating the boat and will respond to you and it will be your choice wether you take it to law enforcement or not.

There is no notary other then mine on this vessel in 25 years, and I have a privet investigation on going looking for any registrations and insurance's, but nothing shows up... It is amazing how each state handles registrations on vessels. Even Connecticut where they messed up, gave me their report from their investigator that says...you cannot register legally any vessel if it is USCG documented unless the Documentation is in your
(The resistors) name and that can only come from a notarized documentation re issued buy the USCG. The fraud has already been determined by officials, with no notary...Thanks again for your time, you have it clear...I just want my boat back as easy and simple as I can do it...

Remember once you have been arrested it stays on your record for life, if your innocent or not, if the case against you is dismissed or not and in today's age you do not want any misunderstandings on your record for a job,credit any thing, because people look at computer information not your face like the old days... I have seen so many people have their rights taken away/lost importunity's because of an arrest from a misunderstanding...
I never want to do that to any one...

That is good but remember that possession is nine tenths of the law. Someone may need to be arrested to make recovering your boat possible.

Larry....It does seem like someone has deprived you of your civil liberties. There is definitely a civil side to this as well as a criminal side. That being said, the civil side only has teeth if you know who did it and where they are. The criminal side has teeth to where if you know who did it, it is a felony, a warrant will be obtained and they will be arrested.

The longer you waffle on this the harder it is to reclaim what is yours and it also makes it so that reclaiming your total boat may be harder. Someone could strip it and part it out and there is a ton of other variables there.

I understand your approach to be nice, but you may have to get the criminal stuff underway. Some places do have time limits on when you can get warrants. Also, MOST criminal justice agencies will wonder why you haven't reported the item as stolen once it has come up missing. Often they put a lot less effort in locating stolen property that has been gone for a long time because the trail is cold.

Just a thought.

you are right but Documentation and Registry is solid and firm, that is why when you by a house you do a title search, to make sure its free and clear before you lay your money down...

Thank you and you are so right about all issues and I have taken all in consideration as I move to the next step.
I will ether get my boat back or some one is going to pay me for the loss, one way or the other.This is the old, give a man to much rope and they'll hang themselves.

Larry, Try to remember that friendship or kinship doesn't extent to theft. That is when it becomes all business. Or else you just walk away.

Yeah, as long as we're just guessing at the circumstances anyway... i

If you agree to "sell" your boat to your no brother good in law on the "payment plan" and he forgets to make payments... he's still your brother in law and you don't have him thrown in jail if you want to maintain peace on the homefront...

Sounds to me like the ex got more than the house and other valuables. Satisfaction has put a smile on many faces. Maybe it's not on the surface anymore? Have you considered Davy Jones' locker? Never underestimate the power of a woman. Hell hath no fury like a scorned woman.
Ask yourself this. How many times (if ever) has the ex asked me about my boat? Gloating? Knowing you are going through hell. Just a thought. Twisting the proverbial knife..
