Yesterday the circuit court in Collier County FL ruled in favor of local cruisers against Marco Islands' restrictive anchoring laws. This is an important ruling and attached is the log from the area cruisers guide. Yippie, a win for boaters..
finally some light at the end of the tunnelWhat I found interesting were these two comments, obviously 180 degrees apart:"You people need to get a life and find some other activity to do besides worrying about this. How would you feel if someone anchored in your backyard for days upon end. You would be the first person to call the police and have them removed. Give it up and go play golf or move back up north." by flcat "flcat, That's the chance you take when you buy a house on the water, these laws have been on the books forever. ..but are there other places in the US that this ruling may affect and thus more anchoring sites will be made available or is this only for the state of Florida? Maybe in celebration they should have a boat rendevou to the island.abe
Based on an article I read, this ruling only impacts Marco Island and the county they are in unless the case is appealed. This is an excert from the article: "Like those of prior courts, Crown’s ruling was a county decision and does not set state precedent, unless it is upheld on appeal. Day said he expected the case to be appealed based on prior statements from Marco government officials.You can read the full article at the link attached.
...The law was clear that Marco and other places could not restict cruisers. Marco was the only one that was trying to impose their own law. This ruling says they can't do that.The judge was pretty mad about it and the phrases he used toward Marco Island was not nice.For what it's worth.Jack
