Dinius has a tough road ahead- here's why-

1. he was charged with boating under the influence causing the death. Clearly, he was legal over the limit. He was found not guilty only because the charge included the manslaughter charge.

2. He isn't suing Perdock for killing Lynn- only her family have the legal right.

3. I think most of us agree the investigation was handled with extreme bias, but in the end, blood tests confirm the dui part of the charge....

The power boat operator should have been charged.
Yes, they should have been charged with BWI but as something incidental that was discovered as a result of the incident and not as it being the primary cause for the reasons you cite. If they had been underway and hit another sailboat then it could be consider contributory. Irving Johnson himself, probably the most sober man that ever lived, could not have avoided that accident if he had been sitting at the helm that night.

It was the boat owners fiancé.
I wondered what the prosecution would have done if they said nobody was at the helm and we were just drifting because there was no wind

problem is--they were going no where and pur-duck was and pur-duck used his authority to negate his very positive result as well --LOL----he was driving drunk too fast in the dark.
i think dinius will have a success in htis one.....too much bs from the sheriffs office in the cover up pur-duck did.....and pur-duck's corruption is sooo obvious.....

who died and made you guys the judge and jury?

I'm so distraught over your rantings and ravings in this case that I can't sleep at night, am having trouble eating, and I keep yelling at my wife. My son is a lawyer and he is suggesting I file charges against all of you for my condition. I might be willing to settle however to avoid legal fees, so let me know if you are willing to negotiate a settlement.
When will we start behaving in accordance with the golden rule and ten commandments and stop all this litigation?
I just had a call from a bank, they tried to sell me 1.2 million dollars in insurance in case I get injured. I asked if I could have the money in advance so I could enjoy myself before my injury after which I probably wouldn't need or want the money. They did not agree but it caused them to hesitate a bit. :)

You should have phrased it to be getting your bonus in advance... Upon the advice of your attorney, you would be willing to set up a structured settlement now - or accept half now as an agreed settlement.

If you are willing to save them half, then they should be willing to agree and cut a check for half now. ..... :>

I once quit a ggoooodd paying job that was legal...but morally wrong to me. Have slept really really good since!
And anyone that faults Dinius in this one...picture Daffy Duck saying..."You are dispicable!"

While the COLREGs may not technically apply on an inland lake, they do form the basis for what is reasonable behavior and what the responsibilities of the parties involved could reasonably be expected to do.

The woman killed was the fiancée of the boat owner IIRC, not of Dinius, who was a friend of the owner.

A lot of us kept up with it on a daily basis and wondered why in the world Dinius was on trial in the first place...and that is ultimately what the jury must have thought.
It was sad!

I must have done a bad job on my earlier posts because I was trying to strongly say the powerboat operator should have been charged. If, after a trial, it was determined there were extenuating circumstances, charges could have been filed against the sailboat operator(s). I never meant to indicate support for the prosecution of Bismarck.
Sorry, I thought I had made that clear.

Since when do the rules not apply to a lake?

The Rules clearly state that they apply to ALL inland waters includine rivers, harbors, inland lakes, and waterways

I think we have been through this Saildog. COLREGS don't apply to a lake. I agree 100% that this was a huge miscarriage of justice though. Hopefully they come up with some speed rules for the lake in question. By the way, the "rules" that we all talk about don't necessarily apply to the CG either. It's like state troopers and the speed limit.
