Interesting question - in the automotive world, if you leave your car unlocked with the keys readily available, you are liable for all damages caused by the person sealing the car....

To add to this story, several years ago here in Oceanside, a broker took his girlfriend on a joy ride with a boat that was being offered for sale. Idiot crashed the boat into the jetty and sank it.
"The owner of a luxury yacht that had to be demolished after running aground at Oceanside Harbor over the weekend said Wednesday the man piloting the boat had no permission to operate it and should face criminal charges.
"Oceanside Harbor Police Sgt. Joe Spurgeon confirmed there is a criminal investigation into the actions of Geoff Quillin, the man who was at the helm of the 56-foot boat on Saturday night when it hit the Oceanside Harbor Beach jetty and sank.
"Quillin could not be reached for comment. Records show he recently worked as a broker out of Breakwater Yachts at the Oceanside Harbor."

A few years back, we had a boat yard worker (there may have been drugs involved) take a sailboat from the yard dock and go blasting up and down the bayou smacking into some other boats and a pier or two. Sherif came and took him away. Yard repaired the damage.

If “key in ignition” liability were extended to boats I wonder how it would work for boats that have no key in the engine control panel, just push buttons to start.
We have a few charter boats at our marina rented frequently by members of the “more money than brains club”. Its commonly referred to here as ‘marina showtime‘.
That's what I was thinking, too... I suppose the engine could be disabled but that's a tricky one given that the manufacturer did not provide any means of security.
