Firearms on Documented Vessel

Can I legally have a firearm on a documented vessel in New York City Waters if I am not there longer than a few days? Does their Sullivan Act prohibit this?

I tend to carry when on vacation

But then again I am a police officer and I am allowed to concealed carry anywhere in the U.S. I like to keep something around because there are a few happy customers out there that I really don't want to see.

Are you sure? Is it just the state you are a police offer in? I know my friend a retire NYC police offer can only carry in NY.

If it is a hand gun and assembled I would think not

If on the other hand, it was disassembled and stored apart it might be legal. I would think that is an avenue you should investigate. Maybe just pulling and stowing the firing pin would suffice. That aside I don't recommend guns on board. Even pirates generally leave people alone unless someone pulls a gun and then all bets are off. They are also bad news if found on board in Canada or even Worse Mexico. You already know that it's going to be a pain in the butt in New York. That said; I have a Stainless 410 shotgun that I got specifically for quieting Halibut, but even that is less trouble when left at home. Good luck Joe S

Call NYPD

Call NYPD because if you are breaking any laws they will be the ones to arrest you or get some wonderful advice on here and hope it is good. IMHO Tony B

It changed after 9-11

Laws changed after 9-11-01. The federal government has passed a law since then that any officer with proper creditials and a badge can carry in the U.S.

You already may have a gun in your flare kit. Threatening to light someone up like a 4th of July display I'm sure is just as effective. -Mark

Maritime Laws May Differ

Maritime Law May Differ, but on land in the state of New York and even more stringent in NYC, hand guns are strictly regulated, long guns rather loosely. Unless you hold a NY LTC or Law Enforcement credential I would suggest that you avoid confrontation and or posession within NYS. Here in Mass. long guns can be brought in from out of state for use by licensed hunters or competitors, but must be unloaded and in a locked case out of reach. Preferably in the trunk of a car or similarly secured. Hand guns may not be brought in unless through an FFL dealer who can only transfer guns to properly licensed buyers.

Firearms aboard a documented vessel

July of 2007 I was boarded by the Coast Guard while bringing my newly purchased Hunter 420 from Kemah, Tx to Vermilion Bay Louisiana. We were traveling up the Sabine River to overnight at the Sabine Pass Port Authority Marina. A Coast Guard gun ship stopped us at the mouth of the Sabine river and boarded us for a Homeland Security check. In converstion with the boarding officer my wife asked about the feasibilty of carrying a weapon on board. The officer responded that they always enquire if there are any weapons/firearms aboard and if there are they will want you to turn them over to them to hold secure while the boarding procedure is carried out. They will return the weapons once they disembark. As to carrying a weapon aboard, the officer emphatically recommended that all cruising vessels in the United States carry a weapon. A weapon aboard your vessel is considered a weapon inside your home. Your right to own and possess. He indicated that this is permissible in the US however if you are going abroad each country has their own rules concerning weapons and you should thoroughly investigate those regulation prior to arriving with any weapon. Obviously you can not carry any concealed weapon without proper permits with you when you go ashore even in the US.

The Coast Guard said 'all boats should carry'! These are the guys who pull drunk dead boaters from the water and see what poorly trained owners do to come to grief, and they want them to carry a gun too???? Training or no training. You're kidding, right?

Weapon aboard Documented Vessel

Fred, I am reporting the facts as were stated by the boarding Coast Guard officers. The bottom line as a Documented vessel sailing in the coastal waters of the U.S. the vessel is considered as a legal domicile and as such you have the right to have aboard a weapon for your protection just as everyone in the U.S. does in their homes. Once again Fred i'm reporting the facts as stated. I'm no attorney and I have not researched this for univeral acceptance. I know their are folks that believe that no one should own and possess a weapon, however the laws of the Land do allow for this and based upon the information provided by official CG folks I believe this to be true aboard a Documented vessel. I believe the original question was is this legal aboard a Documented vessel in the waters off New york. I believe that this applies to any vessel in the coastal United States. As for the wisdom of having or not having a weapon aboard, I have no comment other to say that if any pirate plans to plunder a perceived undefended vessels they will find that some will defend themselves as is allowed by law.

I have carried for some 35 years

I have cruised with a loaded shotgun for some 35 years with no problems at all. Bahamas, Burmuda and U.S as far up as Northern Cheaspeake Bay. Only had one experience in which I wished I had it in my hands. Convinced the guy I had crew on board and he left. I was alone near a island off Winya Bay S.C. Yes Coast Guard always asked and do let them know.

I don't know about NY, but...

the possession of weapons in the home is illegal in the nearby District of Columbia. Whether this local law is constitutional or not is currently being argued at the Supreme Court. At present, defending your home (or boat, or whatever) with a firearm will land you jail. So if you are sailing up the Potomac, and you are packing, you in a heap a trouble, Andy.... I also would not assume anything about being able to carry a firearm on any kind of boat while in NY City limits. It, too, has one of the strictest gun control laws in the nation and claiming ignorance would not be a viable defense,IMHO. I would leave the weapon home if I were headed that way, or get written permission from the police or city attorney prior to entering their waters armed....

A lot of prudent people keep firearms in NYC homes.

They are kept well hidden, have no serial numbers and are untraceable back to the home owner.

over rule state and local laws. If so, a documented vessel could fall under the federal laws. Just a shot in the dark. I do know that a long gun is legally much easier to own than a hand gun, and there is no better defensive weapon than a 12 ga. loaded with buckshot.
