Confiscated boat

At the US Naval Base at Yokosuka, Japan, I had an O'Day 26 in excellent condition. I worked at the marina as marina supervisor. My immediate supervisor, the aquatics manager, was stealing equipment and materials from the marina. When I discovered what he was doing, I confronted him and told him that if he would return the equipment and material I would say nothing. Instead, he fired me on the spot and banned me from the marina. Of course, I wrote a letter of complaint to the base commander, but he paid no attention. Instead, he decided that I no longer worked on the base, I should be banned from the base and my boat and all of my boat spares in my storage locker should be confiscated. Being banned from the base, of course, means that I cannot talk to witnesses or plead my case to the commander. So far I have talked to several lawyers, and they all said that any case against the US military is impossible to win. I am now on my way back to the US, and would like to buy another O'Day 26 from someone in the Washington-Oregon area. If I can find a suitable boat, I intend to homeport it near Bremerton, Washington.

hello richard,unless you are in the military, they can't deprive you of your right to due process. send a letter to those who represent you in congress. it can't hurt. john

Give the Navy another try

Write the Naval Investigative Service in Washington, D.C. with any pertinent details. They have the ability to open cases without the base commander's approval. At the very least, you seem to have had an O'Day 26 stolen from you.

From what you describe I am certain the Naval Criminal Investigative Service will be happy to talk with you. If you have not yet departed Japan telephone the NCIS office at Yokosuka at once. If you have been banned from the base I feel sure NCIS will interview you ashore at a place of your choosing. I would try to pursue this quickly before leaving Japan if at all possible as the whereabouts and recovery of your boat means you should act quickly. Northwest O'days

I own a 26 O'day that I purchased in Seattle, but I have never seen another one in the area or for sale in the northwest. Mine was shipped from the east coast or mid-west. I believe that some O'days were built in California. So, finding one around here might be difficult. Herb, Lopez Island, Washington (San Juan Islands)
