Ya know that had to hurt a bit. Less than a second earlier and the boater gets the stem in his earhole.

Legally the CG vessel...

...was supposed to fall off and let the little boat pass. However like in most accidents, on sea or land, or for that matter in the air too, the little boat did nothing to prevent the accident. He has more than a little fault here too. Jack

CG didnt fall off, etc. clearly in violation of the rules.

GG never 1. eased throttle, 2. turned to port to avoid 2. nor gave proper warning signal (5 blasts, etc.). The stand-on boat wasnt keeping a proper watch ... didnt see the CG boat coming (admitted it ... and thats why one should keep their mouth shut when a camera is running). My "ruling" 75% blame to CG; 25% blame to Powerboater. But with most claim/litigation with the 'gummint' that powerboater will be 175 years of age before he sees any payment of award.

How about this situation: Two sailboats converging. Both are on a starboard tack. Is the boat to starboard the stand-on boat, or is the boat to leeward (the one to port) the stand-on boat?

This Was an Old Video

It was not a Coast Guard boat but rather a Coast Guard Auxiliary boat that hit the unsuspecting speedboater. The video has been floating around the Coast Guard and Coast Guard Auxiliary circles for a while. The cameraman won an Emmy for the story. There were many more things wrong than the clip featured, the coxswain of the Auxiliary boat was almost entirely at fault and was very luckey he did not hurt anyone.

Like many things in life they make rules for people that

are unable or unwilling to give way for someone else. Traffic control signals work perfectly when everybody follows the rules. So do four way stop signs. But occassionally we get someone who just has to be first, that is when we cuss a little and let them through. But when we get two people that must be first, then we get rules of behavior and conflict. Polite goes a very long way to preventing problems.

I hold a 1600ton license, and the rules of the road are always fresh on my mind in regard to work. The Coast Guard vessel was at fault, however, both vessels did a poor job of maintaining proper lookout and an awful job of acting prudently in time to avoid a collision. This is why people get hurt, they jump in a boat, and throw a little alcohol into the mix, with no idea of what etiquette calls for. They're lucky no one was hurt, and the Coastie Coxswain should have been thrown under the bus.

boat is the give way boat. At least in racing.

It was NOT a COAST GUARD BOAT!!!!!!!!!!

Again, the accident boat was not a CG boat. It was an Aux boat with a civilian owner/captain on board. The accident happened during an "exercise" being filmed by the local TV media. That's why it was being filmed. For PR reasons! It boggles my mind that this thing keeps resurfacing. Even the title on U-Tube states it was a CG vessel. IT was edited by SOMEONE to make it look like it was a a CG vessel. Why someone would do that, I don't know. Take a clear look at the first powerboat shown (the actual Coastie), then compare the gunwales of the accident boat with the bumpers hanging down while under way. They're clearly not the same boat. How do I know? Because the local media played it over and over and OVER on a local TV station when it happened here in Milwaukee, a number of years ago. It was a stupid accident with poor showing by all involved but it was not a COAST GUARD VESSEL.
