Also, with regard to PBase, have you checked to see if the URL for a picture changes when you go through the "update image" process as detailed here [link] under the "Can I replace an image without losing comments and hit counts" heading?

Awesome info!! This is why I like you guys so much.. Been on PBase for years and never knew that. Not such a web savvy guy..Ask me about boats, drug delivery systems or some other areas I know or have specialized in and I'll can go head to head all day long but web stuff, very much a novice...

The DMCA is fairly new copyright protection. In this case it would be difficult to enforce because the dirtbags are out of the US.

But just so you know, the law allows up to a $40,000 fine for EACH USE. If your picture is viewed 10 times, that is 10 uses. Adds up QUICK! It is up to the US district attorney in the appropriate jurisdiction to follow up. Some don't seem to care at all and others will contact the offender. Usually one call from a US district attorney and the threat of a MASSIVE fine will get things taken care of pronto.

What I would like to know is whether the California company has liability here. Aiding the perpetrator, whatever.

I wonder if any of the "legal eagles" out there can say what "intellectual property rights" a person has once he/she publishes something on the web that is not explicitly copyrighted or otherwise protected as the property of the author? FYI, I recently had a few on-the-water images of my boat plucked by a broker and used by him, without my permission, in an ad he was running for a similar boat. He was quite contrite when I contacted him and stated that the images were my property and that he could (1) either pay me for their use or (2) take them off his site immediately. He chose the later. Maine, you may want to try the same approach.

Warren the only avenue I have is the search engines and his US host. This is NOT a real company just one set up to PHISH for email addresses. They are also in India the world headquarters for intellectual property thieves. Not much I can do but notify the search engines of this fraud.

Yes, a few times he has had work stolen, both by scanning originals in the pre-internet age, and now by occasional web site rip-offs.

One offender was reproduced his work on T-shirts, 9x11s, and post cards. As my father was in that market and there were material damages, we had to take action (successful).

Regarding web site rip-offs, we keep the images small enough that you cannot make art quality prints. We figure we don't loose many real customers. We do attract real customers. Actually, most of the work that comes from the site is not purchases, but rather commissions to paint homes and boats.

I had a portion of a rock climbing guide I wrote ripped of once years ago. The reality was I wasn't going to sell enough of them that the monetary damage mattered, so I muttered to myself and put it out of my mind. I didn't like it, but it wasn't "material." I took it as evidence that the thief was a poor writer and felt good about that.

I feel you pain, but it's not worth the internal angst. You post because you love to share. We can feel that. I do the same, though to a lesser extent and with less mastery. I do it because I love sharing my little discoveries. It's worth it.
