January 2nd, 2006 at approximately 2 AM the local Shell refinery had a spill. It was high tide and the material flowed over the submerged East Side outer harbor wall and filled the marina. No clean up actions were conducted in the harbor for several day. As a hazardous material professional I can say that the delayed clean up was under staffed, lacked supervision, did not follow standard remediation protocol, used the wrong type of absorbent materials and never addressed any of the real pollution issues. The material was still covering the water around my boat 12 days after the spill. The media has primarily reported the "Shell Company line" and many stories were 180 degrees from the truth. Today is the 19th, 17 days after the spill and I finally got a copy of the Material Safety Data Sheet (MSDS). It took approximately 150 phone calls, 5 letters, 4 visits to public officials, 3 newspaper interviews and 2 TV interviews to get the MSDS. In California under Prop. 65 this information should have been publicly posted knowledge within a few hours of the spill. After living in the middle of a Haz. Mat spill/clean-up zone for the past 17 days I believe the marina is not fit for human habitation due to negative health issues related to the spill. I believe the material is eating or etching into my bottom paint. I believe the material is a potential de-bonding agent that may be melting the 3M 5200 adhesive that is a vital element for all 7 of my through hull fittings. The MSDS confirmed the material has negative health symptoms, verify the negative health effects that I have been experiencing. Now that I've read the MSDS and know what my vessel has been surrounded by for over 2 weeks, I'm sailing on the morning tide. Due to what I believe is a risk to your health and your vessel safety I would advise all boaters to stay out of the Martinez CA Marina until a proper investigation and full clean up been completed.
