Need to register your boat in Maryland when towing it thru the state on I-95 on your way to Florida? No. Well, not YET anyway...

This is a warning to other relocating sailors as well as a vent, because I have my knickers in a twist about this. Yet another example of government sucking money out of us at every turn. :cussing:

I'll try to make a long story longer:
- I bought my boat years ago while a legal resident of DE and registed boat in DE.
- Moved to MD 17 +/- yrs ago, kept boat registered in DE, state of primary use.
- Boat fell into disuse due to life's events. Did not renew registration in DE after 2005.
- Boat sitting in yard (nowhere near a marina) growing moss for last 9 years.
- Desired to get into sailing again to teach young relatives the joy of sailing.
- Attempted to do the right thing and register boat in MD, grudgingly paid exci$e (read - sales tax) on boat I bought 20 years ago in another state (DE has no sales tax).
- Get call from DNR says I should have registered boat in '05 when DE registration expired.
- I explained that boat has never touched a drop of MD water, has been sitting in yard, etc.
- Tough shi7, must register boats sitting in yards growing moss in MD. Penalty for years since 2005 for not being registered. Total = about 10% of boat value.
- First time ever I'm glad that I don't own a Hinkley.

So tell me, how the fark am I supposed to know that you have to register old boats sitting in yards in MD? Some of you will call me stupid, say I should know the law, consulted a lawyer, etc. Really? For a boat sitting in a yard. Show me on the DNR boat registration page where it says I have to register an unused boat. Show me.
Have any of you moved to MD and have an old boat sitting in your yard??? Beware, the DNR Gestapo are looking for YOU! :naughty:

Yet another example of government doing everthing they can to suck money out of honest, hard working people. I fully understand why people are fed up and formed the Tea Party, but that's a discussion for another forum.

This is why people cheat on their boat registrations. I wanted to just renew it in DE, but the wife said "no, do it right". So coughing up 100's of $$ that I cannot afford is the reward I get for "doing it right". Thanks for letting me vent. :evil:

Ha! It looks like you and John Kerry have something in common! He solved his problem by sheepishly paying the taxes in Massachusetts even though he tried to pass it off that his boat was really being kept in Rhode Island, where he was avoiding $500,000 plus or minus. Can you afford to be as magnanimous?!?! ;)

Woodster - wish I had! Last time I listen to the wife "do it right, blah blah blah"...;)

Scott - I wasn't trying to "pass off" anything. I didn't know you had to register a boat sitting in a yard. And, as stated, I paid my penalty as well. Albeit, not as "magnanimou$" as Mr. Kerry.

Biggest problem was in trying to be honest. If you'd have renewed in DE, you'd probably been OK because of keeping her on a trailer and low exposure to Gestapo.. Sorry, Krusty..

Sorry but the laws of the Socialist Peoples Republic of Maryland are quite clear on this ... if a boat/car/truck/airplane is brought into Maryland, anywhere in MD and for any purpose, and the 'grace period' of 90 days expires, you now must register and also pay penalties and interest on the non-payment and penalties.
Of course, you MUST have documented evidence of the date when that 'vehicle' entered into Maryland or the tax penalty clock is backed up to the very last date that you can PROVE via written documentation that the vehicle was not in the Peoples Republic.

If Noah transferred his ark anywhere into Maryland and did not have the paper trail to prove EXACTLY WHEN the boat entered the Peoples Republic, he'd have to pay back taxes, penalties and interest all the way back to "and then God took a rib from Adam".

The Peoples Republic of New Jersey would have been worse although I believe there is just a fixed fine of $25 if over 30 days late.

We have the same issues here in California regarding registration fees, sales tax, use tax, and even county property taxes.

Vessels are required to maintain registration regardless of use. Per CaDMV

Hmmm - and one of my boats had an expired registration- from 2011. I walked in, paid for the current registration renewal, and the gal said- enjoy the boat.

That's in Texas

One must pay the NJ 7% tax. If you registered the boat in Illinois first the tax would be the full 7% minus any tax paid in Illinois. Pay the Maryland tax of 5% then pay another 2% to NJ years later if you register it there later.

I was planning to store my boat on the hard in Nj over the winter but have heard stories of NJ gestapo visiting marinas. Perhaps Del?

Well my read of MD tax law is that at least you do not have to register your life ring or any other watercraft that has no mechanical means of propulsion. Sails and oars are not considered "mechanical" under this rule. If you dingy has a motor mount but no motor it is still considered "mechanically powered" BTW!!!

PFDs
innertubes
skis (the boat yes but the actual skis no)
row boats (can't have a transom motor mount or trolling motor (in sight))
canoes
flotsam or jetsam

That hard shell dingy is starting to look more attractive ain't it?

If you have a car in Md. and hadn't registered it for a few years, would you also have to pay back fees? I don't think our founding fathers would put up with this. I'll be quiet now.

However there is no annual personal property tax; over time this is a savings vs. VA (4.57% per year forever), which is part of why my boats have always been registered in MD. Unfortunately, I get to pay on cars every year.

No annual vehicle inspection in MD, so some areas abound in rattle traps with no brakes. Been hit by 2 ("my brakes didn't work"--gee, I wonder why).

So stop your crying.

You are not required to register a boat in Maryland that is under repair, commissioning or maintenance. Sounds like MDNR determined that you were in use.

The Peoples Socialist Republic of Maryland wants every last cent of your money. How else are they going to pay for the free cell phones for the fine citizens of West Baltimore.

Here is the killer:
"Penalty--§8-716.1(d)(1)–10% of vessel excise tax – assessed when tax is not paid within 30 days of incurring liability."

"Interest--§8-716.1(d)(1)–1.5% per month or fraction of a month from the time the tax was due until paid."

They even calculate the interest to the "fraction of a month"! I think that says it all. :doh: I would have been delighted to pay the NJ fixed fine of $25!

Like Rich said, if they dug up Noah's Ark under the bay, DNR would send a bill to God for storing his boat in MD waters.
