fridge won't shut off

My fridge runs for hours before it shuts off. Gets down to about 28 degrees inside according to my digital probe well away from the evaporator. Doesn't matter if the stat is set on 1 or 7, it just keeps running. I can turn it to the off position and it will quit. When it finally does shut off it is off for many hours until it gets about 41 degrees and then turns on again. My assumption is I have a bad stat. Has anyone had a similar problem? and if so, did a new stat fix it? sps

What brand is it?

Thermostat problem

If the thermostat's OFF position stops compressor you have pin pointed the problem to the thermost or placement of its capillary tube. Mechanical thermostats are just a switch with a gas bellows operated by expansion of a special gas in the capillary tube clamped to the evaporator. As the tube end gets cold the gas contracts reducing the pressure on bellows and opening the switch contacts. It at least three inches of the thermostat capillary tube end is clamped to the evaporator and the box is colder than thermostat setting it should be replace.
