Regarding Dick's "Insurance Fraud" post in this forum; please review the following excerpt from Wikipedia's page on Defamation:

Defamation

In law, defamation (also called calumny, libel, slander, and vilification) is the communication of a statement that makes a false claim, expressly stated or implied to be factual, that may give an individual, business, product, group, government or nation a negative image. Slander refers to a malicious, false, and defamatory statement or report, while libel refers to any other form of communication such as written words or images. Most jurisdictions allow legal actions, civil and/or criminal, to deter various kinds of defamation and retaliate against groundless criticism. Related to defamation is public disclosure of private facts which arises where one person reveals information which is not of public concern, and the release of which would offend a reasonable person.[1] "Unlike libel or slander, truth is not a defence for invasion of privacy."[2]

did you read the other post?

Accusing someone of insurance fraud, and publishing pictures of that person's private property, apparently obtained without their permission via unauthorized access, etc.

Enough....

It's enough to say "hey.. you may be a bit off base here..."

There is also something to be said for mentioning to the owner or harbor master that there is a problem with someone's boat.

No one wants an oil spill in their marina!!! We all are rightly concerned that that NOT HAPPEN!!!!

The owners, most certainly, DO NOT WANT TO FOOT THE BILL FOR A SPILL CLEANUP...

You have read, I take it, the Insurance Contracts and coverage??? Reading BETWEEN THE LINES ---- it could cost the OWNER more than $100K to clean up...

so... unless you have fought a libel or slander suit and just enjoyed the experience - just please give the topic a rest...

Our original poster was concerned.. that's the point... there's no problem in saying "be constructive" in your concern.. no reason to verbally hit people over the head, either....

perhaps our errant boat owner friends DO NOT KNOW HOW MUCH a oil spill cleanup can cost.. it's a lot....

jviss, were those photos obtained with out someones permission?

Does Dick have a slander suite here?
just a thought...
jv, is this that important? Can you not see the fact that neglect, can not only cause damage but striff while it is occuring?
Dick is a man of values and anyone with values that sees, or suspects a wrong doing stands up againt it. That is why our volunteer army is where they know they need to be!
You don't hide from wrongs, even if it means a liable suite. If a wrong is a wrong, there is no liable, it is a wrong!
jv, please take a breath and look back...
sincerely,

Don , the answer ...

to your question "isn't there a non-sailing related forum into which this should be put?" is...YES. It belongs in the Wannabe Lawyers forum. LOL.

Sorry Phil, I try to behave, but it's not always easy. LMAO
