Does any have any information concerning the pending class action lawsuit concerning rudder failures dealing with the 450 and 460 series models?

As a person who believes that there are already potentially too many lawyers in this fine country, I ask this question because I was contacted via a back door to see if I wanted to be a member of the class. However, I do 1)do not like class-action lawyers, and 2)I don't want to ask directly unless I have a much better idea of what is involved.

Quite the carfully worded response. "potentally to many lawyers" Either the guy has a boat with a bad rudder or he doesn't. If he doesn't then why the question? If he does then he should know the issues. Since it is pending how would any of us know about it? Clearly it is a slow day at the office. What do you call a sinking cruise ship full of lawyers? A good start. What do have if you have 50 lawyers burried up to their necks in sand? Not enough sand. If you didn't have lawyers you wouldn't need lawyers.

Interesting, I posted at least 6 known cases of..
rudder failures on the 46 about 3 years ago. The guy who owns "Wonderlust" who sailed around the world lost his rudder...he thought he thought he hit something in the middle of the ocean. I personally think that the rudder failure rate in the H46/456 are too high...interesting the Hunter is one of the few if not the only company that makes an emergency back up rudder. abe

I gave Tim "Buyer Beware #2" some information and advise on how to collect on his judgment. I do collection work in my law practice, and I wanted to help him out. I volunteer at a free legal clinic. While, modesty is not my best quality, I am a downright great person who deals with peoples' problems day after day. Yes, some clients are scamers and money grabbers and some clients have been ripped off by the former. Some clients have been permantly injured or had family members killed by someones negligence, are parents of little kids who have been maulded by dogs, or been hit in a cross walk and the liability insurance companies won't offer fair compensation until a lawyer get involved. Lawyers are advocates and problems solvers, not problem creators. There are bad apples in every group, but your post was intented to insult all lawyers. I will not trade insults with you, just suggest you give some thought to whether everyone who is the target of your "jokes" deserve the ridicule. Scott Wilson

TODAY. I helped break him in as a lawyer back in '71. He was a prosecuting intern. Maybe I should rephrase that; We broke each other in. Nicest guy you'd ever want to meet. The headline today; Prison for 16 months for stealing from the trust accounts of his clients. Stunning. Never, ever, did I observe anything but the highest ethics from him.

The purpose of forming any "professional" group of individuals is the ensure that they extract the maximum cash out of the victims. Plumbers, lawyers, doctors, the list goes ad-infinitum. BUT plumbers leave you with a dry house, doctors leave you with better health, auto mechanics fix your car. What do you get from a lawyer except relief from the other guys lawyer? I was an adjutant in the Army and saw my fair share of lawyers doing their thing. I can't think of one thing that could not have been handled out of court if only the other guy/gal hadn't gone and got a lawyer. But this is a sailing forum and I suspect that lawyers make just as good a sailor as anybody else.

There were 16 Hunters that lost their rudders as of 2005. Hunter was able to review 13 of the 16 lost rudders. Hunter concluded that..."most of which had been in use for more then two years...11 were well within the design and manufacturing tolerances. One rudder post may have had a manufacturing problem, while the other was within the design tolerance but did not meet Hunter's internal tolerance specifications." Hunter concluded that the composite rudder post was the problem. They concluded that the composite rudder post could have damages not readily visible to the owner. They offered Hunter owners with the composite rudder post a stainless steel rudder post at a significantly reduced cost. The owner was responsible for having the stainless steel rudder post installed. Some Hunter owners with the composite rudder post believe that if the failures were with the design and manufacturing tolerances for Hunter sailboats just over two year old, Hunter should pay for the full cost of replacing the composite rudder post with the new stainless steel rudder post. ...to a Hunter rep. He replied that they believe most failures were the result of groundings or other stresses that would have bent a steel shaft but go unnoticed with a composite shaft until it fails. They have switched back to steel shafts for that reason. You can draw your own conclusions, but I'll tell you that for offshore work... and I mean real offshore... you'd be smart to carry an emergency rudder rig regardless of the type of boat. And, don't think a full keel is going to protect you. You can still get water into the framework and lose it. (I sailed on one that did, for example.)
