Nice and easy, I bet that you would have to prove

willful neglect on the part of the defendant before you could get a judgement. I still want to know about the damage control efforts that are made by those boat crews that do strike a container. Or for that matter how many of us have considered damage control in the event of a collision?

A not so funny story.....

Lots of containers were washed up in Long Beach, Ms. from the neighboring Gulfport Ms. Port during Hurricane Katrina. These containers were broken apart from the ravaging storm. They contained 10's of thousands of Tyson's Chickens. So, in addition to all the other storm related problems, the stench was so overwhelming that it hampered local residents from trying to recover their broken apart lives. I know an Atty that lived there and he and others sued. The mess was finally cleaned up but I dont know by who or what.I'm sure that someone can always be held accountable, but trying to collect is a different story. Foreign countries dont shell out money like we do. Your legal fees would probably exceed the value of your boat.  IMHO Tony B

...no one has commented on the obvious. What about the captain being responsible for a good look out and avoiding collisions?

It's difficult...

...to say the least to post a watch for something that is below the surface. Unless you have forward looking sonar in your boat you run the same risk, watch or no watch.

...once we were skooting along north of seven knots about a hundred miles west of Cabo San Lucas with three of us on deck on a clear afternoon and came within fifty feet of the remains a floating dock that we were nearly on before we spotted it. If we'd hit it, we most certainly would have holed something. Rick D.

A lookout

Is is not possible to maintain a proper lookout for floating things in the water when single handing. Matter of fact, pretty hard to do with a full crew on board. Some of you must not be familiar with these containers. They are all different colors, and some are, believe it or not, blue or turquoise. Almost the same color as the water, and for all practical purposes invisible if floating a few inches below the surface. So while a good lookout is a good thing, a turquoise colored container floating just on or below the surface, is pretty much going to be a matter of either you hit it or you don't.
