Bent shaft

I have an Oceanis41 Beneteau with Perkins engine. Before moving it on the water checked an engine and there was some vibration. My partner noticed that the shaft was bent in the place where it goes from the propeller into the boat. We had no problem last year and we did not hit anything during the season and propeller itself has no damage. The only possible explanation is: when Marina took our bout out of the water last October they damage the shaft. Actually I observed when few attempts were made to take it out and they change the belts position few times.

please advise what is the best plan of action and should be Marina responsible for this damage and what is the best way to proceed beside apparent necessity to repair it first using our time and resources.

Proving they did it would be tough. I am always present when they lift mine, but that's still my word against theirs. I've started taking video every time to document any mistakes.

My B323 2006 has markers near the toe rail for the sling location. There are even some spares in case the originals falls off.

My slip neighbor had his bent in that way and had to replace the shaft. Like others I'm always there but mostly because I'm nervous about a drop and I think it makes the operator a bit more cautious. That said I have marked where the straps go according to the manual, during my first haul I also marked "extreme" positions such as how far back is the speed sensor paddle wheel and how far back is the shaft and so on....

All crane operators so far have pulled slightly off the marks but I will not allow outside the "extreme" marks, which hasn't happened yet. Every time they've had to adjust it too, start pulling and then go back and reposition slightly. Not sure what they look for but so far never had an issue but hauling the boat always makes me nervous.

Takes a really experienced operator to know where to put the straps without guide marks, and if you have an uncommon model the operator might never have done one before. Best to have the marks.
On one of my boats the shape of the hull would cause the straps to slide apart of they weren't tied together. As I was telling the operator that he said he knew, he'd done that model before, and I didn't want to know how he learned it. Glad I wasn't the first!

Oh and I forgot to mention that if I remember right the yard did not take responsibility for my neighbors shaft so he had a new shaft put in somewhere else and never went back...
